Employers awarded public construction contracts with government agencies, administrative institutions, or state-owned enterprises are eligible if the total contract value is at least NT$100 million, and the project duration is at least 1.5 years.
Alternatively, if the total contract value is between NT$50 million and NT$100 million and the project duration is at least 1.5 years, the employer may still be eligible if the accumulated contract value for other public construction projects under the same employer reaches NT$100 million.
Employers awarded contracts for privately invested major infrastructure projects are eligible if an individual construction contract is valued at NT$200 million or more, with a project duration of at least 1.5 years.
Alternatively, if the contract value is between NT$100 million and NT$200 million and the project duration is at least 1.5 years, the employer may still be eligible if the accumulated contract value for other private major infrastructure projects under the same employer reaches NT$200 million.
For public construction projects, the number of foreign workers that an employer can hire is limited to 20% of the total workforce, based on the contract value and project duration as calculated under the Project Cost Act. However, for projects that score 80 points or higher based on grading indicators and formulas, the foreign labor allocation ratio may be determined by multiplying the total score by 0.004 (4 per thousand).
For major private infrastructure projects, the foreign labor allocation follows the same 20% workforce limit, calculated under the Project Cost Act based on the contract value and project duration.
